This Legal Notice regulates the conditions of use and navigation of this Website of the INCLUD_US European Project (hereinafter, 'the INCLUD_US Site').

The access, navigation and use of the INCLUD_US Site implies holding the condition of user of the same (hereinafter, 'the user') and, consequently, the express and unreserved acceptance by the user of all the terms and conditions contained in this Legal Notice. 2. Website: use, purpose and applicable legal regime

The INCLUD_US Consortium makes the INCLUD_US Site available to users for the following purposes: to publish information about the project co-funded by the Erasmus+ program of the European Union and to share good practices, resources and documents related to inclusive experiences for young people with disabilities.

With regard to the INCLUD_US Site, it is also subject to European and Spanish legislation.

3. Acceptance of the conditions of use

Access to all the functionalities provided on this INCLUD_US Site implies acceptance of each and every one of these conditions, as well as any other that may be established, modified and/or extended due to present or future Service needs.

4. Conditions of access and use

Access to the different functionalities existing on the INCLUD_US Site is free of charge. No profile creation, registration, or prior registration is required. Therefore, the user who visits the INCLUD_US Site agrees to the following:

• Use the INCLUD_US Site exclusively for the purposes and functionalities provided for this purpose by the INCLUD_US Consortium, and the user is prohibited from using the INCLUD_US Site for any other purpose or means.

• Do not try to access, use and/or manipulate the data of the INCLUD_US Consortium or its partners. In particular, and merely indicative and not exhaustive, the user agrees not to transmit, disseminate or make available to third parties information, data, content, messages, that may constitute a violation of the rights of INCLUD_US Consortium, its partners or from third parties.
• Do not access without authorization or interact with a false identity, impersonating or not the identity of third parties or using a profile or performing any other action that may cause confusion or mislead as to the correct identification of the user in question.

5. Industrial and intellectual property

The user acknowledges and accepts that all industrial and intellectual property rights over the contents and/or any other elements of the INCLUD_US Site (including, without limitation, brands, logos, trade names, texts, images, graphics, designs, sounds, databases, data, software, presentations, audio and video, if introduced), are the exclusive property of the INCLUD_US Consortium, each of its partners or third parties that have specifically authorized INCLUD_US for this purpose.

In no case does accessing or browsing the INCLUD_US Site imply any type of waiver, transmission, license or total or partial assignment of said rights, unless otherwise expressly established in writing.

All intellectual and industrial property rights on the contents and/or services of the INCLUD_US Site are reserved and, in particular, it is prohibited to modify, copy, reproduce, publicly communicate, transform or distribute, by any means and in any form, the entire or part of the contents included therein for public or commercial purposes, if you do not have the prior, express and written authorization of their respective owners.

The user who violates these limitations and prohibitions acknowledges assuming exclusively any responsibility in this regard, leaving INCLUD_US Consortium, any of its partners or third parties harmless that may be affected as a result of the user's actions.

6. Exclusion of warranties and liability

INCLUD_US Consortium does not guarantee:

• The availability and continuity of the operation of the INCLUD_US Site.
• The absence of viruses or other elements on the INCLUD_US Site introduced by third parties outside the INCLUD_US Consortium and that may cause alterations in the physical or logical systems of the users or in the documents, archives and files stored in their systems.
• That unauthorized third parties cannot have access to the type of use of the INCLUD_US Site made by the user or the conditions, characteristics and circumstances in which said use is made.

Consequently, INCLUD_US Consortium and its partners will not be responsible in any case for any damages that may derive from the aforementioned or from:

• The interruption in the operation of the INCLUD_US Site or computer failures, breakdowns, disconnections, delays or blockages caused by deficiencies or overloads around the systems or mechanisms that allow its operation
• The lack of suitability of the INCLUD_US Site for the specific needs of users
• Other damages of any nature or that may be caused by third parties due to the use of the services, the contents or through unauthorized interference beyond the control of INCLUD_US Consortium
• Damages that may be due to the lack of information, accuracy or lack of veracity of the information that they provide within the framework of the INCLUD_US Site and its service, and in particular, although not exclusively, for damages of any nature that may be due to the impersonation of a third party by a user in any kind of communication or action carried out through the INCLUD_US Site.
• The use that users and/or third parties may make of the INCLUD_US Site, nor the damages that may derive from it.

The INCLUD_US Consortium will take various measures to protect the INCLUD_US Site and its contents against computer attacks by third parties.

The INCLUD_US Consortium reserves the right to suspend without prior notice access to users who, in its opinion, fail to comply with the rules of use of the INCLUD_US Site and to exercise the appropriate legal measures, without thereby generating any compensation right in favor of the user. that might be affected by it.

7. Jurisdiction and applicable jurisdiction

Any controversy in relation to this Legal Notice will be substantiated before the European jurisdiction or the corresponding jurisdiction of the country of its partners, expressly agreeing the parties to submit to the jurisdiction of the corresponding Courts and Tribunals, unless the applicable regulations establish the competence of other Courts and Tribunals for these purposes.

INCLUD_US Consortium reserves the right to modify this Legal Notice, to adapt it to future legislative, doctrinal or jurisprudential developments that result from application, or for technical, operational, commercial, corporate and business reasons, previously and reasonably informing users of changes that occur when possible.
